Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Virev API at api.virev.ai and the associated developer portal ("Service"), operated by Virev AI ("we", "us", "our"). By creating an account,
generating an API key, or making a request to the API, you agree to be bound by these Terms. If you do not agree,
do not use the Service.
2. Description of Service
The Service is a commercial, dollar-balance HTTP API that returns publicly available Instagram data, including
profile records, post records, real-time profile lookups, real-time post and timeline lookups, and AI-driven
profile enrichment. Endpoints, request shapes, and per-request prices are documented in the developer portal and
the OpenAPI specification at /openapi.json.
3. Account Registration & API Keys
You must create a developer account through our authentication provider (Clerk) to issue API keys. Each account has one active API key at a time; generating a new key automatically revokes the prior key. You are responsible for:
- Keeping your API key confidential — treat it like a password
- All requests made with your API key, including those by team members and contractors
- Rotating the key promptly if you suspect compromise
- Providing accurate billing information and a valid payment method when topping up your balance
Sharing API keys with unauthorized third parties or embedding them in client-side code is prohibited.
4. Acceptable Use
You agree not to:
- Use the Service to violate any applicable law (including export controls, sanctions, anti-spam, and data-protection laws)
- Reverse-engineer, decompile, disassemble, or attempt to extract source code from the Service
- Resell, sublicense, or expose the API to your customers as a substitute for them obtaining their own keys, except through a written reseller agreement with us
- Use the API to build a product whose primary purpose is to compete with the Virev API or replicate its core functionality
- Circumvent rate limits, balance checks, or pricing — including by rotating accounts, using multiple unrelated keys to bypass quotas, or fraudulent payment methods
- Use returned data to harass, dox, surveil, or otherwise harm any individual
- Use returned data in violation of Instagram's or Meta's Platform Terms — including using public data to identify users for prohibited purposes
- Submit malicious payloads or attempt to compromise the security or integrity of the Service
- Probe, scan, or load-test the Service without our prior written consent
5. Public Instagram Data — Use Restrictions
Although the data returned by the API is gathered from publicly available sources, you remain responsible for the lawful and ethical use of that data. In particular:
- You must comply with Instagram's, Meta's, and other relevant platforms' terms when using returned data — including any restrictions on storage, redistribution, or downstream use
- You must honor takedown and deletion requests from creators you have queried, in line with applicable privacy law
- You may not use returned data to build datasets for facial recognition, biometric identification, or surveillance
- You may not use returned data to train large language models or other foundation models without our prior written consent
- You may not use returned data to make automated decisions that produce legal or similarly significant effects on a creator (employment, credit, housing, insurance) without explicit human review and a lawful basis
If you operate in the EU/UK, you are responsible for determining your own controller status under GDPR and for honoring data-subject rights of creators whose data you query and store.
6. Billing, Balance & Refunds
6.1 Pre-Paid Balance
The Service operates on a pre-paid, dollar-denominated balance. You add funds via Stripe (one-time top-ups or configurable auto top-up). Each request deducts an amount from your balance equal to the published cost for that endpoint. Costs may include volume bonuses or promotional credits as published in the developer portal.
6.2 Pricing Changes
We may change endpoint pricing or introduce new endpoints. We will give you reasonable advance notice of price increases that affect existing endpoints — typically through the developer portal and email — and the new price will apply only to requests made after the effective date.
6.3 Auto Top-Up
If you enable auto top-up, you authorize us to charge your saved payment method off-session (without re-entering card details) when your balance falls below your configured threshold. You can disable auto top-up, change the threshold, or remove your card at any time from the developer portal. Repeated auto top-up failures will automatically disable the feature for your account.
6.4 Refunds
Funds added to your balance are non-refundable except where required by law or expressly granted by us in writing. Charges for successful API responses (HTTP 2xx) are final. We do not bill for upstream failures (5xx returned to you, upstream timeouts).
6.5 Taxes
Prices are exclusive of taxes. You are responsible for any sales, use, VAT, GST, or similar taxes assessed on your purchases.
7. Service Levels & Availability
We aim for high availability but do not provide a contractual uptime guarantee under these public Terms. Our upstream Instagram data depends on the availability and policies of third-party platforms (Meta / Instagram), which we do not control. We may schedule maintenance windows and will use reasonable efforts to minimize disruption.
8. Suspension & Termination
We may suspend or terminate your access immediately if:
- You violate these Terms or any applicable law
- Your balance is exhausted (suspension is automatic; access resumes when you top up)
- We detect abuse, fraud, chargebacks, or unsafe traffic patterns
- Required by law, court order, or platform partner
- You attempt to use the Service to harm Virev AI, our customers, or third parties
You may close your account at any time from the developer portal. Upon termination, your remaining balance is forfeited unless required to be refunded by law or unless we agree in writing.
9. Intellectual Property
The Service, including the API, gateway code, the developer portal, and our documentation, is owned by Virev AI and protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable license to call the API and use returned data subject to these Terms. We retain all other rights. Public Instagram data returned by the API is not owned by us — your right to use it is bounded by the originating platform's terms and applicable law.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT INSTAGRAM DATA RETURNED WILL BE COMPLETE OR CURRENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIREV AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Virev AI, its officers, employees, and agents from any third-party claims, damages, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your use of data returned by the API, or (d) your violation of any third-party rights, including the Instagram or Meta platform terms.
13. Changes to the Service & Terms
We may modify or discontinue any part of the Service at any time. We may update these Terms from time to time; material changes will be posted on this page with a new effective date and, where required, communicated to active accounts by email. Your continued use of the Service after changes take effect constitutes acceptance.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The exclusive jurisdiction for disputes is the state and federal courts located in Delaware. Where a dispute is not subject to mandatory consumer-protection rules of your home jurisdiction, you agree to bring claims only in those courts.
15. Miscellaneous
These Terms, together with the published pricing, OpenAPI specification, and any written agreement we sign with you, are the entire agreement between us. If any provision is held unenforceable, the remainder continues in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of substantially all of our assets.
